树形象严格考核考评工作
为了加强对审判工作考核考评的领导,我院专门成立了考核考评委员会,考核考评委员会主任由院长担任。其职责一是实施对全院各项制度的执行、落实情况检查、督查;二是负责对全院审、执结案件的综合考评检查;三是负责对二审改判、发还案件的考评检查;四是承担与审判活动密切相关的如庭审观摩、裁判文书评比等其他工作任务。为了提高考评办工作人员的工作积极性,在政治待遇、经济待遇上给予政策倾斜。
考核考评的组织机构建立健全及考评办力量充实后,我院针对基层法院特点,及时出台了“考核考评制度”、“奖惩制度”、“末位淘汰制度”等,细化了审判考核指标。考核考评制度中明确了考核考评的任务、职责及工作程序,规定每
月印发“考核考评通报”一期,全面详细通报每一位干警的日常行为规范及每一案件瑕疵等考评情况,每季召开一次考核考评委员会例会,研究解决考核考评中的有关问题。院内除对刑事、民事、行政、立案、审监、执行等分类按庭百分制量化考核考评外,还制定“干警个人考核书”,实施了对每一位办案法官的百分制考核,把办案任务数、结案率、执行率、当庭宣判率、息诉服判率、改判发还率、上诉维持率、申诉抗诉率、按期审执结率、调解率等十多项明确具体的指标任务落实到每一件案件、每一位法官身上,年终考核考评后,超指标者奖,不达指标者罚,对各项考核居于末位的,下岗培训三个月,培训经考试合格后,方可重新上岗,不合格者,予以辞退。
考评办在院考评委员会的直接领导下,雷厉风行地展开了案件评查工作。考评办五名工作人员中除一名书记员专门负责案卷交、接、转工作外,其余四人均参与案件考评。考评案件的范围是各审判业务庭、执行庭审、执结的案件,二审维持、改判、发还的案件,本院提起再审、检察机关提请抗诉的案件。考评实行逐案填写考评表,逐人建立考评档案,逐月通报考评情况的方法;考评的内容从实体裁判、适用法律、审判执行程序到裁判文质量,审、执期限、公开审判、当庭宣判及卷宗装订等方方面面。考评结果是干警奖励处罚、提拔使用的重要依据,凡年内出现一件三、四类案件者,除进行经济处罚、行政处分外,一律不得提拔使用,对考评优秀者除给予经济上的奖励外,在提拔使用上优先考虑。求实效开拓创新抓改革
在强化管理促审判工作中,我院提出了“带一流队伍,创一流业绩”的工作口号,要求各部门负责人都要有创新意识,树立“无功就是过,保守就是错”的新理念,积极谋求法院的发展。一是全面推行“三分立”和审判流程管理,实现了从立案、分案、指定承办人,指定案件审限、结案、执行以及审限管理等各个环节的电脑网络化管理,开通了局域网,建立了审务大厅,实行了“窗口式服务”,形成了“大立案、精审判、强执行、重监督”的运行机制。二是重视合议庭改革,注重强化合议庭职责,放权于合议庭,并对合议庭的组成、职责、审理、评议、裁判、监督、考核等作了详细的规定,规范了合议庭制度,提高了审判质量。三是开展证据制度改革,进一步完善和规范了举证导引制度,实行证据收据制度,建立健全了当事人申请人民法院调查取证制度,推行举证时限制度,维护了当事人的合法权益。四是深化庭审方式改革,全面推行了案件的繁简分流,扩大简易程序审理范围,建立了速裁法庭,对事实清楚,证据充分,争议不大的民事案件和简单刑事案件,均实行简易审理,并由专人送达,专人在专门场所审理,当庭宣判或当庭调解,五日内结案,实现快审快结,并本着方便当事人诉讼的原则,对部分基层法庭的管辖范围进行了调整,以方便群众,减轻了群众诉累。同时还专门成立了“基层人民法庭指导领导小组”以加大对基层法庭工作的指导力度,改变过去对基层法庭疏于管理状况。五是强化法律文书改革。根据市中院《关于全面提高全市法院裁判文书质量的意见》和统一制定的裁判文书写作规范格式,我们在裁判文书的改革方面着重加强了证据的分析与认定,注重了文书的论理性,消灭了文书的错别、漏字现象,以此提高审判的社会效果,树立司法权威,使裁判文书质量迈上了新台阶。六是进行执行工作改革。为了深入贯彻十六大精神,切实解决执行难,最大限度地保护当事人的合法权益,维护法律尊严,去年以来,我们下大力气加强执行工作,加大执行工作的改革力度,严格对债权凭证发放工作的管理,实行执行案件的流程管理,对执行案件的立案、分案、排期、送达、调查、
